By accessing or using the DigitalRecruiter™ OS platform and associated services ("Services"), you confirm that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use our Services.
DigitalRecruiter™ OS provides an AI-powered enterprise talent acquisition platform comprising a fleet of AI agents (including Hiro, Naviga, Scouty, and Hunter), diagnostic tools (StartDiag), process mapping tools (ProcessIQ™), and associated consulting and implementation services. Services may be provided via web platform, API, or as part of a managed engagement.
Our Services are intended for use by enterprise organisations and their authorised representatives. By using the Services, you represent and warrant that you have the authority to bind your organisation to these Terms. Individual consumer use is not supported.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
Your use of candidate and employee data through our Services is subject to our Privacy Policy. You acknowledge that you are the data controller for any personal data processed through the platform and that DigitalRecruiter™ OS acts as a data processor on your behalf. You are responsible for obtaining all necessary consents from candidates prior to using AI-assisted screening or interview tools.
All intellectual property rights in the DigitalRecruiter™ OS platform, including but not limited to the AI agent technology, interface designs, trademarks, and proprietary methodologies (including StartDiag and ProcessIQ™), are owned by or licensed to DigitalRecruiter™ OS. No licence to use these assets is granted except as expressly set out in these Terms or in a separate commercial agreement.
Each party agrees to keep confidential any proprietary information received from the other party in connection with the Services, and not to disclose such information to third parties without prior written consent, except as required by law.
The Services are provided on an "as is" and "as available" basis. While we take all reasonable steps to ensure reliability and accuracy, we make no warranties, express or implied, regarding the fitness of the Services for any particular purpose, uninterrupted availability, or the accuracy of AI-generated outputs. You acknowledge that AI screening and interview tools are decision-support tools and should not be the sole basis for employment decisions.
To the maximum extent permitted by law, DigitalRecruiter™ OS shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services. Our total aggregate liability to you in connection with the Services shall not exceed the fees paid by you in the three months preceding the relevant claim.
Either party may terminate access to the Services upon written notice in accordance with the terms of the applicable commercial agreement. We reserve the right to terminate or suspend access immediately where we reasonably believe a material breach of these Terms has occurred.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
We may update these Terms from time to time. We will notify enterprise clients of material changes by email or via the platform. Continued use of the Services after notification constitutes acceptance of the updated Terms.
